My stepdad helped raise me. He didn't have a will. Do I have any rights to his estate?

Unfortunately, stepchildren have no automatic rights when a stepparent dies without a will in BC.This reflects a gap in BC estates law that doesn't yet recognize diverse family structures — including the many families where step-parents play the role of a parent in every practical sense.

BC estates law uses the term "child" in several important ways when someone dies without a will. A child can inherit the estate, handle funeral arrangements and apply to administer the estate. However, the law only counts biological children and legally adopted children. Stepchildren don't qualify.

Who inherits instead

When someone dies without a will, BC law sets out who inherits. If the deceased doesn’t have a spouse, the estate goes to the deceased's descendants (their biological or adopted children). If there are none, it goes to their parents. If the parents have died, it goes to their siblings. The list continues through more distant relatives.

Unfortunately, stepchildren aren't anywhere on this list. Your stepdad's estate could very well go to a distant cousin he never met, while you get nothing. This is true even if you had a close relationship. This outcome can feel deeply unfair, especially when the relationship was close and loving. The law doesn't always reflect the complexity of real family bonds.
